Step 1: Prepare a Strong Personal Petition Letter<\/strong><\/p>\n\n\n\n

This is the foundation of your application. The letter must explain:<\/p>\n\n\n\n

\u2022 What you have studied and what you are skilled at<\/p>\n\n\n\n

\u2022 The role your work has in meeting national needs<\/p>\n\n\n\n

\u2022 Why not accepting offers from other countries is good for the United States.<\/p>\n\n\n\n

Step 2: Gather Supporting Evidence<\/strong><\/p>\n\n\n\n

\u2022 College or university transcripts<\/p>\n\n\n\n

\u2022 Resume\/CV<\/p>\n\n\n\n

\u2022 Letters from people knowledgeable about the discipline<\/p>\n\n\n\n

\u2022 Publications, patents and citations are forms of evidence.<\/p>\n\n\n\n

\u2022 Examples of results from before and what is happening now<\/p>\n\n\n\n

\u2022 Being acknowledged by the government or by an industry organization<\/p>\n\n\n\n

Step 3: File Form I-140 (Immigrant Petition)<\/strong><\/p>\n\n\n\n

This form is submitted to USCIS<\/strong> along with all your supporting evidence. As an EB2 NIW applicant, you are your own petitioner<\/strong>.<\/p>\n\n\n\n

Step 4: Wait for Approval and Priority Date<\/strong><\/p>\n\n\n\n

Once your Form I-140<\/strong> is approved:<\/p>\n\n\n\n

1. If your\u00a0priority date is current<\/strong>, you can immediately file Form I-485 (Adjustment of Status) if you are in the U.S.<\/p>\n\n\n\n

2. If you\u2019re outside the U.S., your case will be sent to the National Visa Center (NVC) for\u00a0consular processing.<\/strong><\/p>\n\n\n\n
