EB-1A: Persons with extraordinary ability in sciences, arts, education, business, or athletics (no employer required).
EB-1B: Outstanding professors and researchers with international recognition.
EB-1C: Multinational executives or managers transferred to the U.S.
Processing Speed: Fastest among EB categories (no PERM required).
EB-2: Advanced Degree or Exceptional Ability
For professionals with high-level qualifications.
Requires a job offer and PERM labour certification.
Two subcategories:
Advanced Degree: Master’s or higher (or bachelor’s + 5 years’ experience).
Exceptional Ability: Significant expertise in sciences, arts, or business.
National Interest Waiver (NIW): Allows self-petition if work benefits the U.S. (no employer or PERM needed).
EB-3: Skilled, Professional, and Other Workers
For individuals with lower educational or skill thresholds.
Skilled Workers: Minimum 2 years of job experience or training.
Professionals: U.S. bachelor’s degree or foreign equivalent.
Other Workers: Unskilled labour (less than 2 years training/experience).
Requirement: Job offer + PERM labour certification.
EB-4: Special Immigrants
For certain non-citizens under unique categories.
Includes:
Religious workers
U.S. government employees abroad
Armed Forces members
Afghan/Iraqi translators
International organization workers
No PERM typically required.
EB-5: Immigrant Investors
For foreign investors contributing to the U.S. economy.
Invest $1.05 million (or $800,000 in Targeted Employment Area).
Create/preserve 10 full-time U.S. jobs.
No employer sponsorship needed.
Leads to conditional green card, then permanent status.
